Abstract

The paper points out the specifics in connection with serving prison sentences in the Special Department of the Correctional Penal Institution in Požarevac intended for serving prison sentences for criminal offenses of organized crime, considering that prisoners there serve their sentences in a special regime, involving isolation from the general prison population, as well as special treatment. This is primarily due to the fact that the position of persons serving a sentence in a special regime is less favorable compared to those who are not in such a regime, because the rights of prisoners in the Special Department are not the same as the rights of other prisoners. Certain basic rights of those serving a sentence in the Special Department are denied or unjustifiably limited and certain provisions of the law are not in line with the system of execution of criminal sanctions embodied in the Law on the Execution of Criminal Sanctions adopted in 2014. Special attention is paid to the need to create an essentially effective practice in dealing with this category of prisoners in terms of treatment (work therapy), which is an obligation of the state and which must also be made possible for those who are serving their sentence in the Special Department, considering that this is the only way to achieve the purpose of serving a prison sentence.
