Abstract

This article examines the incidence of costs in probate litigation caused by the negligent drafting of wills. It outlines the possibility of obtaining a costs order against a negligent draftsman following the conclusion of probate proceedings. It also examines the difficulties in bringing separate professional negligence proceedings to recover costs and considers arguments raised by the parties before the Supreme Court in Marley v Rawlings.
