Pojęcia podrobienia oraz przerobienia zabytku — art. 109a u.o.z. (w perspektywie orzecznictwa)

Abstract

The undertaken goal of research is to depict the concepts of: a monument, counterfeiting of a monument and remaking of a monument. The analysis is based mainly on – firstly – the views expressed in the jurisprudence, as well as – secondly – on the linguistic understandingof these concepts. The issues of “counterfeiting” or “remaking” of a monument are analyzed in the warp of art.109a of the statute of 23 July 2003 on the protection of monuments and the care of monuments. The literal understanding of the concepts of “counterfeiting” and “remaking” is highly important during making a comprehensive interpretation of the provision of art.109a of the statute of the protection of monuments and the care of monuments.
