Abstract
Potency is a force, a virtual act, and has to be differentiated and distinguished from privation and simple possibility and on the other, from even the worst imperfect act. The word potency test has been engraved in the medico-legal scenario so deeply that after every arrest for sexual crimes, the police presents the accused person before the Forensic expert so sincerely and promptly even before submitting him before the Hon. Court with a requisition for “Potency test”. The physical examination of external genitalia which excludes anatomical abnormality or pathological diseases should be labeled and requested as to look for “physical evidence of erectile dysfunction” rather than the conventional “potency test”. The fact that the desire to have an erection is subjective, circumstantial and conditional makes the term “Potency test” more inappropriate.
