Abstract

Perlindungan Masyarakat Hukum Adat di Wilayah Pesisir Pasca

Abstrak Indonesia sebagai Negara kepulauan yang terdiri dari pulau-pulau besar dan kecil yang terpisahkan lautan dengan kondisi geografis memiliki luas total 7.827.087 Km2 dan terletak di zamrud khatulistiwa memiliki kekayaan sumber daya alam yang berlimpah, khususnya di wilayah laut dan pesisir yang luasnya mencapai 3⁄4 wilayah Indonesia (5,8 juta Km2). Pasal 18 B ayat (2) dan Pasal 28 I ayat (3) UUD NRI 1945 sebagai dasar konstitusional pengakuan dan perlindungan hak-hak masyarakat hukum adat di wilayah pesisir dan Pulau-Pulau Kecil. Kekayaan sumber daya alam berupa wilayah Pesisir dan Pulau-Pulau Kecil dikuasai dan dikelola oleh Negara untuk sebesar-besarnya kemakmuran rakyat. Pengakuan Negara terhadap eksistensi masyarakat hukum adat terkait sumber daya alam tidak konsisten. Adapun rumusan masalah dari penelitian ini adalah (1) Konstruksi hukum UU Cipta Kerja terhadap perlindungan masyarakat hukum adat di wilayah pesisir. Hasil dari penelitian ini adalah hukum yang dikehendaki adalah hukum yang sifatnya memberi perlindungan terhadap warga masyarakat yang termasuk masyarakat hukum adat di wilayah pesisir dan pulau-pulau kecil, kemudian instrumen hukum yang tidak memihak pada pengakuan keberadaan Masyarakat Hukum Adat, contohnya pada UU Cipta Kerja yang belum memihak kepada Perlindungan Masyarakat Adat di Wilayah Pesisir dan Pulau-Pulau Kecil.
