Abstract

The essay launches the presentation of a research path dedicated to the world of trade union representation, its measurement and the effects of such measurement on collective bargaining and on the application of the law that refers to collective agreements signed by the comparatively most representative trade unions. In the current regulatory framework, the essay reconstructs, in particular, the evolution of the contractual rules applicable to the confindustrial system, drawing: a) the attention to the absence of continuity between the 2014 single text and the 2018 interconfederal agreement; b) highlighting the reasons that make legislative intervention and the possible methods and techniques of intervention necessary.
