Abstract

A good system for procurement of goods / services is a system of procurement capable of implementing the principles of good governance and bringing efficiency and effectiveness of public spending. However, there are several obstacles in the activities of procuring goods / services such as abuse of authority in the procurement of goods / services, conspiracy between procurement officials and providers of goods / services, and multiplying the price of goods in order to gain personal or group benefits. The issuance of Presidential Regulation Number 16 of 2018 concerning Government Procurement of Goods / Services is the government's answer to fix problems in the procurement of goods / services, one of which is in the realm of Administrative Law. So that the problem arises What is the Form of Abuse of Authority in the Procurement Process of Government Goods / Services and What is the Legal Consequences for Abuse of Authority in the Process of Procurement of Government Goods / Services As for this writing using normative legal research methods. The results show that in the procurement of goods / services, State Administrative Law regulates the legal relationship between providers and users in the preparation process, the tender stage to the post-tender stage process to analyze the forms of abuse committed by the election working group and officials making commitments as well as solutions in preventing misuse in the procurement of goods / services so that the principles of creating good governance in the process of procuring goods / services.
