Abstract

Tindak pidana persetubuhan merupakan problema manusia, yang mana terjadi pada seorang yang tidak menggunakan akal serta ditambah dengan dorongan hawa nafsu dalam bertindak. Terdapat beberapa faktor mengapa tindak pidana persetubuhan terhadap anak semakin sering ditemui di Indonesia salah satu penyebab karena adanya kemajuan teknologi yang membawa dampak positif dan negatif. Bentuk pelecehan seksual anak termasuk meminta atau menekan seorang anak untuk melakukan aktivitas seksual (terlepas dari hasilnya), memberikan paparan yang tidak senonoh dari alat kelamin untuk anak, menampilkan pornografi untuk anak, melakukan hubungan seksual terhadap anak-anak, kontak fisik dengan alat kelamin anak (kecuali dalam konteks non-seksual tertentu seperti pemeriksaan medis), melihat alat kelamin anak tanpa kontak fisik (kecuali dalam konteks non-seksual seperti pemeriksaan medis), atau menggunakan anak untuk memproduksi pornografi anak.
 Sanksi bagi pelaku tindak pidana persetubuhan terhadap anak diatur dalam Pasal 287 Kitab Undang-Undang Hukum Pidana (KUHP) mengenai kejahatan seksual yang beberapa aturannya mengatur mengenai kejahatan kesusilaan terhadap perempuan dan anak. Sanksi bagi pelaku tindak pidana persetubuhan terhadap anak diatur secara khusus dalam Undang-undang Nomor 17 Tahun 2016 tentang Perlindungan Anak. Pentingnya peraturan perundang-undangan tersebut demi memberikan perlindungan terhadap anak, hal ini dikarenakan dari tahun ke tahun, masalah yang menimpa anak semakin meningkat. Anak yang seharusnya dilindungi dari tindak kejahatan-kejahatan saat ini malah menjadi korban tindak kejahatan, terutama dalam kasus seksual atau persetubuhan.
 The crime of copulation is a human problem, which occurs in a person who does not use reason and is coupled with the impulse of lust in acting. There are several factors why sexual acts against children are increasingly common in Indonesia, one of the causes is due to technological advances that have positive and negative impacts. Forms of child sexual abuse include soliciting or pressuring a child to engage in sexual activity (regardless of the outcome), providing indecent exposure of the genitals to a child, displaying pornography for a child, having sexual intercourse with children, physical contact with a child's genitals (except in certain non-sexual contexts such as medical examinations), viewing a child's genitals without physical contact (except in non-sexual contexts such as medical examinations), or using a child to produce child pornography.
 Sanctions for perpetrators of sexual intercourse against children are regulated in Article 287 of the Criminal Code (KUHP) regarding sexual crimes which several rules regulate crimes of decency against women and children. Sanctions for perpetrators of criminal acts of sexual intercourse against children are specifically regulated in Law Number 17 of 2016 concerning Child Protection. The importance of these laws and regulations in order to provide protection for children, this is because from year to year, the problems that befall children are increasing. Children who should be protected from crimes today become victims of crime, especially in cases of sexual or sexual intercourse.
