Abstract
Abstract This chapter focuses on rules of customary international law that are not of general application but are applicable among some States only. It explains the place and scope of these rules of particular customary international law, including by reference to several cases before courts and tribunalst in which such rules have been invoked; it also notes that these rules may not necessarily be based on a geographical relationship. The chapter further discusses the stricter application of the two-element approach as regards rules of particular customary international law as well as the burden of proof that is laid upon those who seek to rely on them.
