Abstract
This article deals in several aspects with the incompatibilities between the modern and western categories of politics and law with the demands concerning the migratory phenomenon, especially regarding the refugee problem. It analyzes, at first, the insufficiency of theses that depart only from a moral duty to the inclusion of refugees. Then, it discusses the issue of the granting of rights to immigrants, especially refugees. Finally, it presents a critique of how democracy becomes excluding by keeping the conflict in the same patterns of a class struggle. Keywords: legal sociology, migration policies, refugees.
