Abstract

Infrastructure development in Indonesia faces challenges in its development process, land acquisition is the most difficult process, the community does not have trust in the government to provide land according to the agreed value, difficulties in land acquisition, namely land acquisition for development for the mutual benefit of both the government and the private sector so that solutions are sought in accordance with applicable legal provisions and the objective of increasing the quantity and quality of the national mining business is achieved. This study uses a normative legal study method with a qualitative approach, primary and secondary data are strengthened by expert opinion, so that this research has a state of the art. The results show that the opportunities and challenges of land acquisition are based on the determination of the location and the release of rights and fair compensation, and it is also possible for private companies to carry out the process of compensation and relinquishment of rights.
