Abstract
After 1975 Spain began the difficult process of transforming its political system. The changes included the electoral system, but rather than only reconstructing the system, the principles of how to elect the representatives of the Spanish nation were stipulated anew. Therefore, the paper attempts to answer the question of whether the solutions adopted fully reflect the principle of national representation, as intended by their authors. It is also necessary to present the proposals to reform the Spanish electorate system suggested by Spanish academia.

Maj1c na uwadze z3o¿ony system rz1dów istniej1cy w Hiszpanii (na poziomie ogólnokrajowym, autonomicznym, lokalnym, jak równie¿ europejskim), stosowane s1 ró¿ne systemy wyborcze w celu wy3onienia odpowiednich cia (Kongres Deputowanych i Senat, Zgromadzenia Autonomiczne, Korporacje lokalne, Parlament Europejski). 69.2 i 5 wprowadzi3a dwie grupy senatorów: 1) tych wybieranych w prowincjach, wed3ug systemu wiêkszoœciowego (wiêkszoœæ wzglêdna) przy zachowaniu zasady równej reprezentacji wszystkich prowincji – ka¿da prowincja wybiera 4 senatorów (wyj1tkiem s1 Baleary i dwie prowincje kanaryjskie; odpowiednio 5 i 11 senatorów, jak równie¿ Ceuta i Melilla, których mieszkañcy wybieraj po 2 senatorów), niezale¿nie od ogólnej iloœci mieszkañców, co powoduje usankcjonowanie nierównoœci pomiêdzy poszczególnymi prowincjami („koszt” mandatu bêdzie siê zasadniczo ró¿ni w du¿ych, zaludnionych prowincjach i w ma3ych z niewielk liczb mieszkañców); 2) desygnowanych przez Wspólnoty Autonomiczne, wed3ug kryterium reprezentacji proporcjonalnej, bowiem oprócz jednego senatora wyznaczanego przez wszystkie Wspólnoty, wskazuj one dodatkowo po jednym senatorze na ka¿dy milion mieszkañców ich terytorium.
