Abstract

The article is a response to the polemical remarks by Professor Łukasz Pohl in reference to his proposal of amendment to Article 12 of the Penal Code. The text focuses on the issue of imposing a stricter penalty for a continuing offence, as implemented by Article 57b of the Criminal Code enacted in June 2020. In the opinion of the author, this provision envisages a stricter criminal repression for perpetrators of a continuing offence, but it is not yet another Criminal Code-based ground of an extraordinary aggravation of penalty.
