Abstract

The present article aims to present the real situation of the Judiciary in face of the new pandemic scenario in Brazil and of Family Law, notably regarding the dissolution of marriage before the increase in the volume of this legal institute which had an evolution in the development of the Brazilian forensic system not far from the current days. This work also presents another way of breaking up family entities, such as the stable union, which was also affected in a huge way with the advent of the pandemic. Bringing the need for de-judicialization of divorce and stable union, in order to protect the dignity of the human person, who seeks in this delicate moment, greater procedural speed in order to obtain the outcome of a marital relationship and / or affective unsustainable with freedom to do so without the intervention of the State. It is clear that the volume of the procedural burden leads to more bureaucracy, resulting in the slowness of the proceedings. The conclusion of this study is that the de-judicialization is an effective and necessary measure for the debureaucratization of the divorce process in the Brazilian legal system. To carry out this work, a basic, strategic, descriptive and exploratory research was used, with a qualitative approach and a hypothetical-deductive method. The bibliographical and documental research and situation analysis procedures were used.
