Abstract

The right to obtain information about the environment has been widely guaranteed by the Polish constitutional lawmaker and the ordinary legislator. The matter of access to environmental information is the most widely regulated by the Act on access to environmental information. The right of access to information has a wide objective and subjective ranges. This may lead to the abuse of the right by applicants. The existence of such a state is not directly regulated by the legislator in the legislation of public law. This does not prevent from considerations concerning the abuse of public subjective right. The matter has been raised in this article. The reflections are based on both the achievements of the doctrine and jurisprudence of the administrative courts.
