Abstract

The concepts of “copyright” and “economic right” are older than theory of author’s right as personality right. There are two theories behind the origin of moral rights. One is the dualist theory founded by Joseph Kohler which says that moral rights are independent of the economic rights. Second is the monist theory which is recognized in German jurisprudence. According to the theory, developed by Ulmer, there is no bifurcation between the ‘material and the ideal rights’.
