Abstract
The paper deals with the modernization of private international law of maintenance in Serbia in the light of the two newest international instruments drawn up by the Hague Conference on Private International Law. As Serbia has ratified the Hague Protocol on the Law Applicable to Maintenance Obligations in January 2013 introducing modern rules to the legal system of Serbia, the issue of ratification of the Hague Convention on the International Recovery of Child Support and Other Forms of Family Maintenance has arisen, in order to modernize this aspect of the international maintenance as well. In order to establish a position on the issue, the paper presents and analyzes the essential provisions of the Convention (scope of application, administrative cooperation, recognition and enforcement of decisions, stricto sensu enforcement). Based on the analyses, the concluding remarks offers some elements on the bases of which the competent authorities could form an opinion on the necessity and desirability of the ratification of the Convention.

Summary
Међународно приватно право издржавања Републике Србије су све до недавно чинили Закон о решавању сукоба закона са прописима других земаља из 1982. године[2] (у даљем тексту: ЗРСЗ) и међународни споразуми. ЗРСЗ, као главни извор домаћег међународног приватног права који се примењује у свим случајевима у којима питања издржавања са иностраним елементом нису регулисана другим законом или међународним уговорима[3], садржи одредбе о меродавном праву за обавезе издржавања, о међународној надлежности судова Републике Србије и о признању и извршењу страних одлука. Године.[15] Ова је према датуму усвајања прва универзална – данас би се рекло глобална – конвенција са великим бројем држава уговорница и која и данас опстаје због значаја предмета који регулише.[16] Тај предмет је у члану 1 одређен као олакшавање остваривања „издржавања на које неко лице, даље у тексту названо поверилац, које се налази на територији једне од Страна уговорница, полаже право на потраживање од неког другог лица, даље у тексту названо дужник, које потпада под јурисдикцију друге Стране уговорнице.
