Abstract

The care of people with mental health problems has been much in the news recently because of the publication of the new draft Mental Health Bill and the controversy surrounding it. The main argument against the Bill relates to its assertion that people with mental health problems should be forced to get treatment, even if they have not consented to it, if it is deemed that there is a potential risk of them causing harm to others. As the law currently stands, people with personality disorders cannot be detained if they have not actually committed an offence. However, politicians have been keen to introduce compulsory detention in the wake of high-profile cases such as that of Michael Stone who murdered Lin Russell and her 6-year-old daughter Megan.
