Abstract

The main goal of this study is to analyze the situation of the institution of mediation in the Republic of Ka-zakhstan and identify areas that need further reform. The article examines the institution of mediation as a historically formed and evolving, complex socio-cultural phenomenon, which to one degree or another is re-flected in various cultures from ancient times to the present day. A brief analysis of the emergence of media-tion in the USA and Europe is given. Particular emphasis is placed on the development of mediation in Ka-zakhstan, which began with the adoption of the Law “On Mediation” in 2011. The article also reflects the key differences between modern mediation and its historical model. The authors of the article highlight the stages of development of the institution of mediation, show the experience and features of the development of medi-ation, as well as the problems that hinder its formation in Kazakh society
