Abstract

The article examines the changes in legislation regarding the rights and duties of military personnel in Ukraine due to the introduction of martial law. In particular, it was found that since the introduction of martial law in Ukraine, one of the priority areas of legislative activity is the updating of the legislation that regulates the rights and duties of military personnel. The article presents new legislation regarding: the right to a pension; grounds for termination (termination) of contracts with the Armed Forces of Ukraine; rights to health care and medical assistance; duties of military personnel; rights to rehabilitation, etc. In particular, a list of legislative acts regarding amendments to the current legislation in the researched area is given and, through the comprehensive application of methods of systematic analysis of their provisions, as well as a comparative analysis of the updated legislative provisions with the previous editions of the relevant laws, a number of changes have been established: the circle of persons who have the right has been expanded retired; the range of rights of military servicemen from among foreigners and stateless persons undergoing military service under a contract has been expanded; the circle of military personnel has been expanded, who have the right to health care and medical assistance; the content of the right to medical assistance has been expanded; the right to «combat immunity» is established; the range of duties of military personnel has been clarified; the range of servicemen entitled to rehabilitation has been expanded, etc. It has been proven that the general state of Ukrainian legislation, which regulates the rights and duties of military personnel in Ukraine, improved significantly during the period of martial law. At the same time, despite the established significant progress on the way to improving the legal status of military personnel under martial law, attention is focused on the expediency of continuing active legislative activity regarding the regulation of the rights and duties of military personnel in Ukraine. It is emphasized the need for further scientific research of legislative amendments regarding the rights and duties of military personnel in connection with the introduction of martial law in Ukraine. In particular, in the part of regulation of rights and obligations, which was not considered in this article, given its limited scope.
