Abstract

This chapter looks at the main sources of law, focusing upon English law, but referring also to Canadian, Australian and New Zealand law, explaining the functions of parliament and the courts in making law and explaining how laws can be accessed and understood. The role of the judiciary in interpreting and advancing the common law, as well as dangers in usurping the role of parliament when doing so, are considered, as well as the impact of European Court jurisprudence.
