Abstract
The article presents an approach on the construction of otherness in the Brazilian legal system, from the narrativist theory of law on the jusliterary look of the popular poems under analysis. The study also dialogues with the jurists' theoretical common sense (Warateana category), which enables a critical perspective of the other in the interpretative reality of the rules.
