Abstract

The article runs a review of ancient, medieval, modern and contemporary sources that used the word “norm”. It allows to establish this thesis: the word “norm” has never been considered as a technical term of legal science, as opposed to “rule” that early entered as such in the vocabulary of the Roman jurists. Only in the second half of the nineteenth century through the work of the German criminalist Karl Binding, the word “norm” acquired a technical sense as logical and conceptual budget of positive statutes and spread in the terminology of law, as well as a generic term to cover different specific types precepts.
