Abstract

The absence of rules in case of data controller’s death, in the recent regulation on data protection, points out the necessity to examine this circumstance on the basis of the regulatory principles governing data processing operations and inheritance law. The outcome of the analysis is that, considering the data controller’s irreplaceable obligations, there is no exception to the ordinary inheritance rules, and the heirs shall not succeed in the data controller’s duties, but will only respond, eventually, for his lack of diligence.
