Abstract

Adoption can be a solution to save children who have lost their parents due to the Covid-19 pandemic, if it is accompanied by legal protection and fulfillment of the rights of adopted children as children. The plurality of the inheritance law system in Indonesia is currently not optimal in providing legal protection for adopted children, because it does not provide certainty and justice equally. This research examines the inheritance of adopted children from the maqasid al-Qur'an perspective as an effort to realize national legal unification. This qualitative literature research resulted in the following findings: (1) Legal adoption in Indonesia is a promise of brotherhood (wila') which can give rise to mutual inheritance rights between adopted children and their adoptive parents; (2) The share of inheritance for adopted children can be equated with biological children if the adoptive parents do not have biological children, and one-sixth if the adoptive parents have biological children; (3) legal unification of the inheritance of adopted children can be carried out by referring to legal sources that are universal, humane, justice and legal certainty without including religious, racial, ethnic and ethnic identities.

 ABSTRAK
 Pengangkatan anak dapat menjadi solusi untuk menyelamatkan anak korban kehilangan orang tua akibat pandemi Covid-19, apabila dibarengi dengan perlindungan hukum dan pemenuhan hak anak angkat sebagai seorang anak. Pluralitas sistem hukum kewarisan di Indonesia saat ini belum maksimal memberikan perlindungan hukum bagi anak angkat, karena tidak memberikan kepastian dan keadilan secara merata. Penelitian ini mengkaji kewarisan anak angkat perspektif maqasid al-Qur’an sebagai upaya mewujudkan unifikasi hukum nasional. Riset pustaka dengan secara kualitatif ini menghasilkan temuan: (1) Pengangkatan anak yang dilakukan secara legal di Indonesia merupakan janji persaudaraan (wila’) yang dapat menimbulkan hak saling mewarisi antara anak angkat dan orang tua angkatnya; (2) Bagian waris anak angkat dapat dipersamakan dengan anak kandung bila orang tua angkat tidak memiliki anak kandung, dan seperenam bila orang tua angkat memiliki anak kandung; (3) unifikasi hukum kewarisan anak angkat dapat dilakukan dengan merujuk sumber-sumber hukum yang bersifat universal, humanis, keadilan dan kepastian hukum tanpa menyertakan identitas agama, ras, suku, dan etnik.
