Abstract
The article deals with the problem of the coercion impact on the participants' interests in criminal proceedings as an element of their procedural status. The mechanism of the coercion use in criminal proceedings involves the impact not on the rights and obligations of the participant in criminal proceedings, but on his interests. The mechanism includes 3 levels: at the fi rst level, coercion is implemented by giving a person involved in the orbit of criminal procedural relations the procedural status of a participant in criminal proceedings; at the second level-by mandatory involvement of a participant in criminal proceedings in procedural relations involving the performance of their procedural duties; at the third level - by applying specifi c measures of procedural coercion to a participant in criminal proceedings. Based on the analysis of various levels of enforcement in criminal proceedings, as well as examples of assessing the interests of the individual in criminal proceedings, the author comes to the conclusion that procedural violations of the interests of the person in criminal proceedings must be the autonomous ground for their appeal both in administrative and court order.
