Abstract
The impact of globalization on the automotive industry, especially motorcycles in Indonesia, as well as the challenges faced by consumers related to defective products. With the rapid growth of the number of motorcycles, from 5 million units in 2022 to reach 6.2 million units by the end of 2023, the industry shows a significant increase in people's purchasing power. However, an accident related to a broken motorcycle frame revealed a hidden defect in the product, which triggered an investigation by the National Transportation Safety Committee (KNKT) and the Ministry of Transportation. This study uses a literature study method and applicable laws and regulations, using an analytical descriptive methodology to evaluate Aspects that can give rise to legal responsibility for business actors regarding products with hidden defects Legal Responsibility Of Business Actors For Broken ESAF Framework Which Causes Losses To Consumers according to Law Number 8 of 1999 concerning Consumer Protection (UUPK). The results show there are 2 aspects that can give legal responsibilities to producer are: Duty of care and Providing Warning and Instructure Information as consumer rights fulfilment. Furthermore, consumer protection is specifically regulated in UUPK does not specifically regulate hidden defects. In general, at Article 19 by using strict liability principle, by providing instructions and warnings, it is hoped that business actors can provide concern to consumers so that they can take better care of their goods and be free from product liability as intended in Article 27 UUPK.
