Abstract

The India Model BIT 2015 was released by the Govt. of India on 28th December 2015. It was unveiled as a draft for all future Bilateral Investment Treaties and for the renewal of existing BIT’s. It was a bold attempt on the part of India as for the first time a capital receiving/ host state has made a draft to protect the interest of its citizens and sustainable use of its resources. Through the course of the article some of the innovative features of this Model BIT have been discussed and compared with the new drafts of multilateral treaties which have been written in the western nations such as the Draft Transatlantic Trade and Investment Partnership, the Trans Pacific Partnership and the EU-Canada CETA.
