Abstract

The paper looks at ways to make the Indian judicial system more progressive and discusses the reformative measures for the same, also consider a lucrative option for economic development. The paper has been categorized study of Indian judicial system in two ways, firstly by studying independence of the judiciary and secondly by judicial review. Judicial Independence – the judiciary’s ability to make decisions absence of extra-legal influence while, Judicial Review – the judiciary’s ability to declare acts of government unconstitutional. Judicial Independence should have a positive impact on economic development, contrary Judicial Review should have no impact unless constitutionally enumerated property rights exist. A researcher by this provides an important insight into the nature of the relationship between the judiciary and economic development. Along with, reformative measures to make the Indian judicial system more progressive, the paper looked at these in two ways common propositions & judicial engineering. The paper critically analyzing the Indian judicial system with Judicial Independence & Judicial Review and reformative measures in the form of Common Proposition and Judicial Engineering establish direct relation in country’s economic development. Furthermore, the paper discussed overburdened judiciary and how it is impacting development, investment in the economy and trade, also economic development with the help of judicial pronouncement/decisions.
