Abstract
Unlike other legal sciences, the science of civil law did not produce any meaningful theory of inaction as a legal fact. The purpose of this article is to fill in this blank space. As a result of research, the author exposes certain features of the legal fact of inaction in the branch of civil law and draws conclusions regarding it – as a special type of act, in a number of cases having signs of action.

Taking into account the revealed branch features of inaction of understanding in civil law, we offer the following definition for it: “Inaction in civil law is regulated by the right, conscious or unconscious, lawful and illegal, having or not having external expression, legal act by means of which the authorized person exercises a subjective right, and the obliged person does not carry out or in an inadequate way carries out the duty assigned to them or carries out it not up to the end, up to an inadequate image, or evades their assigned duties by not performing them by means of a concrete way of operation.”

The science of civil law did not produce any meaningful theory of inaction as a legal fact. Некоторые авторы до сих пор отрицают возможность позитивного бездействия[6] или утверждают, что бездействие не подлежит нормативно-правовой регламентации.
