Abstract
This article is concerned with studying the impacts of the Brazilian Constitution of 1988 on the expansion and consolidation of national legal research. The work is guided to show historical recovery and critical academic experience, seeking to achieve greater scientificity and efficiency of the recognized graduate programs in Law. The chosen methodology is empirical and a survey in Lattes Platform was carried out in order to identify the number of researchers records (masters and doctors). The data collected were analyzed annually to identify the rate of growth in Law scientific research. Finally, the study discussed the importance of public funding for the maintenance and operation of the national graduate program system, the current problem on the negative effects of public funding crisis and profound change of the constitutional principle of public education gratuity before the likely approval of the Constitutional Amendment n. 395/14.Keywords: constitutionalism, academic discourse, post-graduation in law.

Summary
Pode-se inferir que, a partir dos currículos cadastrados na Plataforma Lattes nas décadas estudadas, em 1996 constam 82 (oitenta e dois) doutores e 108 (cento e oito) mestres; já em 2006, são 470 (quatrocentos e setenta) doutores e 1.267 (um mil, duzentos e sessenta e sete) mestres. Os dados trabalhados são fortes indicativos do significativo aumento do número de programas privados de mestrado e de doutorado, os quais determinaram um novo perfil de formação de pesquisadores titulados na história recente deste país.Tal fato ocorreu na medida em que sua taxa percentual de crescimento superou expressivamente a expansão das mantenedoras estatais atuantes no segmento.
