Abstract

Considers potential liability for lenders to companies in the UK as a consequence of environmental legislation. Notes that liability can result either directly, from the effect of legislation on the lender or indirectly, from the effect on the borrower. Concludes that the more significant consequences of the stricter environmental controls should not be the changes in drafting of loan documentation but, rather, changes in the attitudes of lenders.
