Abstract
The doctrine of consistent interpretation guarantees an open attitude of the ECJ towards the international legal order and then contributes to limit the development of the European union (EU) legal order as a self-contained regime vis-a-vis international law. Despite its importance, there is little literature on the consistent interpretation doctrine addressing international law. This chapter analyses the current state of this topic. The section of this chapter analyse the foundation and rationale in the EU law of the doctrine of consistent interpretation. and explores the judicial practice of consistent interpretation concerning (a) the EU international obligations, and (b) other international rules not formally binding upon the Union. An assessment of the relevant jurisprudence is contained in the final section. the brief analysis of ECJ's decisions contained in this chapter shows the importance of consistent interpretation vis-a-vis international law in determining the effects of international law within the EU legal order.
