Abstract

This paper attempts to answer the questions of Football Dataco v. Yahoo! UK Ltd. referred to the European Court of Justice by the English High Court, Chancery regarding copyright protection for football match fixture databases in the English and Scottish football leagues. Discussed first is the method of creation of the fixtures and the facts of the case at the trial court. I then analyze E.U. Directive 96/9 and the pertinent case law within the framework of the Chancery Opinion. Finally I answer the questions referred to the ECJ by the Chancery and discuss the influence these answers would have on EU IP law.
