Abstract

Abstract The first CPT report which is sent to a state begins with a preface re printed from the First General Report of the Committee.1 This stresses, inter alia, the following. First, that the CPT is not a judicial body and so it is not concerned with establishing as a matter of fact that breaches of treaty obligations regarding torture or inhuman or degrading treatment or punishment have occurred. Secondly, that the ECPT aims for ‘conflict avoidance’ not ‘conflict solution’ and so the CPT is concerned with prevention through a process of co-operation.
