Abstract

Old Civil Code does not distinguish between termination of marriage and its dissolution by divorce, stating that divorce occurs by death of a spouse, death or judicial declaration of divorce. Family Code introduced aceasra distinction is maintained under current regulation, so that the termination of marriage is a different case of its dissolution, which can be achieved through divorce. Divorce can be extrajudicially (administrative or notary) or judicial.
