Abstract
F.A. Hayek has presented a comprehensive lecture on modern liberalism in his opus mag-num Law, Legislation, Liberty. In the course of the book not only the political theory of the liberal order was presented, but also legal theory that matches the principles of the former. New legal theory and the new understanding of the very concept of the law as constructed in an opposition to the legal positivism and natural law. This article indicates the crucial ideas concerning the third theory and provides am layout for an approach to further inves-tigation of this proposed hypothesis and subject of study.
