Abstract
Countries shall take measures at the national level for sharing benefits arising from natural genetic resources in an equitable way according to Article 15.7 of the Convention on Biological Diversity. Why and how Costa Rica and India apply the mentioned obligation? This paper will focus on legal measures for prevention and solution of conflicts rising from absence of an equitable sharing of benefits, because balance between various stakeholders interest could be achieved through legal institutions and rights in these two countries. Therefore, countries can avoid disputes on this issue.
