Abstract

The article is devoted to the study of the elemental composition of the forensic characteristics of human trafficking. It is noted that a quick, complete and comprehensive investigation of criminal offenses related to human trafficking is impossible without the use of modern advances in forensic science, in particular, without the use of forensic recommendations reflected in the methodіcs of investigation of this crime. The basic element of any particular methodics of investigating of crimes is considered to be a forensic characteristic. Its essence is that it is considered as a system that contains signs and data on the regular connections of traces, expressed by the appropriate degree of probability and established on the basis of generalization of materials of criminal proceedings, tested by investigative practice. Such data form the basis for the construction of systems of standard versions, which are used in solving specific investigative tasks and promoting further versions. Emphasis is placed on the fact that the task of methodological recommendations for the investigation of crimes is to develop standard systems (algorithms) of actions of the investigator, which contribute to the selection of optimal behavior during the investigation of a particular type of crime. Forensic methodic makes extensive use of criminal law, criminology, and criminal procedure data while developing recommendations. Its information sources are the scientific provisions of the theory of forensic science, data from other sciences, the results of generalization of investigative and judicial practice, the rules of relevant legislation and other regulations. Based on the study of the opinions of scientists, analysis of the results of generalization of the practice of pre-trial investigation and court proceedings on the facts of human trafficking, the elemental composition of the forensic characteristics of the crime under Art. 149 of the Criminal Code of Ukraine is established, which includes the identity of the victim; typical ways of preparing, committing and concealing a crime; typical traces and circumstances of the crime; the identity of the offender.
