Abstract
Management Right on Land (HPL) is right outside in Act No. 5 of 1960 on Basic Regulation on Agrarian Principles (Undang-undang Pokok Agraria/UUPA) that grow and develop in accordance with the demands of the development. Rights that has existed since the colonial era already formulated in a special regulation, so that the holders of HPL with are third parties who utilize HPL within the law and morals. Development held in Indonesia still requires the existence of HPL, due to limited government funds and the empowerment of government agencies central government and local government. HPL may become a test of the right control of the country. Are the economically weak have a place in existence in order to compensate parties who HPL always "land eklpoitation " the investors.Key word: Management Right, value, development.

Apabila kerancuan ini terus berlangsung, maka akan berdampak kepada persoalan pertanahan yang tidak kunjung selesai.[1] Suka atau tidak suka HPL adalah realitas pembangunan Indonesia yang masyarakat sangat heterogen dan struktur tanahnya sangat variatif. Penguasaan Tanah Negara), dengan kata lain tanah negara adalah tanah yang belum dilekati sesuatu hak. Sejatinya menurut hukum tanah negara adalah, tanah yang kontras dengan tanah hak Suhariningsih, 2007, Aspek Yuridis Tanah Terlantar Dan. Pembangunan Indonesia menuntut eksistensi HPL perlu disempurnakan untuk dikoreksi sesuai dengan hakekat dan prinsip-prinsip hukum baik itu segi filosofis, yuridis dan sosiologis. Fakta hukum menunjukkan pembangunan yang tengah berlangsung di Indonesia masih memerlukan keberadaan HPL sebagai bagian dari hak menguasai dari negara, segera diatur dengan tepat dalam rangka mengatasi persoalan kemiskinan, ketidakmerataan penduduk, letak geografis Indonesia, pemusatan pembangunan, dan dampak dari tanah terlantar.
