Abstract
The title of this chapter contains the word “donation”. In dealing with gamete and embryo donation, the Human Fertilisation and Embryology Act 1900 (“the 1990 Act”) provides in Section 12 that no money or other benefit shall be given or received in respect of any supply of gametes or embryos unless authorised by directions, and by virtue of Section 41, anyone who contravenes that provision commits an offence. The Code of Practice (paragraph 3.29) provides that the Human Fertilisation and Embryology Authority (HFEA) will give directions on this matter. The words “or other benefit” should not be construed too literally. If a baby results and is regarded as a benefit, then you might, if the Act is to be construed literally, find yourself in prison!
