Abstract
Abstract A State shall conduct all of its space activities, including military space activities, with due regard to the corresponding interests of other States. This Rule is derived from Article IX of the Outer Space Treaty (OST). It is designed to ensure that States exercise their freedom of exploration and use of outer space, including the Moon and other celestial bodies, in a manner that does not prejudice the interests of other States and of the international community as a whole in their exploration and peaceful uses of outer space. As such, the obligation to exercise due regard is intended as a means of balancing the rights and interests of many States in the exploration and use of outer space. This Rule applies to all activities in space, including military space activities, although it does not apply between belligerents during an armed conflict.
