Abstract

The test, in the procedural field, is quite important when it comes to convincing the judge of the facts. From there derives the need to investigate it, especially in its documentary evidence mode against the principle of contradiction. Therefore, the investigation has as a general objective, to determine the scope of the violation of the fundamental rights of the process, the production of the documentary evidence in an erroneous way and its consequences within a non-criminal judicial process. In order to determine the results of the investigation, the bibliographic and historical-logical review research methods have been used, with a qualitative approach, which allows characterizing the practice of documentary evidence against the principle of contradiction within non-criminal processes.
