Abstract

The Inter American Court of Human Rights has developed a vast case-law regarding the fight against impunity and access to justice, especially in cases pertaining the creation and application of amnesty laws. However, those developments have led to tensions within transitional justice mechanisms –at least in theory– that are underway in America. The present work identifies such tensions, and proposes a change of perspective regarding the Court’s approximation towards amnesty laws within transitional justice contexts: from a uniform application towards a tailor made approach.
