Abstract

According to the so-called doctrine of the margin of tolerance, public administrationsare not liable for damages caused by their unlawful decisions when these arethe result of a reasonable and reasoned application of the law, i.e., when the relevantpublic administration acted with due care when issuing them. This paper analyzeswhy and to what extent this doctrine is justified, especially in view of the severe criticismit has received in recent years.
