Abstract

The Contract is one of the most important private law institute for society and the economy, adapting to social desires and market demands. It responds to socio-economic changes and that justifies the evolution of its concept over the years. Its flexibility and importance to the economy and to the business models has justified economists’ interest in studying this theme. The Law and Economics has provided important reflections and has contributed to the construction of the contemporary legal concept of contract. The challenges resulting from Economy 4.0 are decisive to a Contract Law study focused on the function, which allows us to investigate the effectiveness of the contract to the new business models.
