Abstract

The development of information technology world of the internet today has many positive impacts in people's lives. But with the internet is not denied there is also a negative thing caused. The existence of the internet a lot of new evils appear in the community such as cybercrime, cyberporn and cybersex. The Internet makes it easier to make transactions using credit cards, the benefits of credit cards can lead to new crimes such as carding crime which is a form of crime from cybercrime. However, nowadays carding is one of the problems that is difficult to be handled by POLRI, because in handling the case, the police difficult to find evidence. Despite the promulgation, Law Number 11 Year 2008 on Information and Electronic Transactions is not enough to face the current crime of carding. Carding crime can’t be equated with ordinary theft, carding action done by carder more utilize the development of technology and information. However, the legal capacity to cope with crime has decreased, this is because the legal structure with the function of law does not develop in parallel way, so that law enforcement tends to continue to weaken. In this case, the issues raised are: (1) How criminal law enforcement in handling credit card crimes is related to Law Number 11 Year 2008 on Information and Electronic Transaction, and (2) What are the police obstacles in conducting an investigation.
