Abstract
The purpose of this article is to characterize the right of unilateral termination ad nutum or without cause given by the contract to the parties, from the point of view of the Chilean Civil Law. This is done by establishing their legal status and scope of action. The article studies the juridical nature of this clauses, the distinctions with other similar figures, the requirements necessary for their use, their effects and their annulment. This allows us to understand the right of unilateral termination without cause as a remedy of contractual origin that safeguards the future interest of the parties that do not wish to continue with the contract.

Summary
La facultad de poner término a un contrato, de forma unilateral y sin que exista incumplimiento, ha recibido cada vez mayor atención, tanto desde un punto de vista teórico como práctico, pues es un hecho que es cada vez más común su utilización[1]. Se excluye de este estudio las formas de terminación unilateral consagradas por la ley, las que ya han recibido atención por parte de la doctrina más reciente[3]. Procuraremos tratar en este artículo el régimen jurídico de las estipulaciones contractuales por las cuales se da a las partes el derecho de poner término anticipado al contrato, en los casos en que la ley no ha conferido ese derecho, y sin que sea necesario un incumplimiento para su activación[4]. Se utilizan expresiones como desistimiento, retracto, denuncia, revocación y terminación para designar a la facultad descrita, consistente en poner fin al contrato de modo unilateral sin necesidad de expresar causa[6].
