Abstract

This work addresses the challenges and recognition of cultural diversity from a legal perspective, specifically focused on studying the difficulties, obstacles and negatives that indigenous peoples and neighborhoods have received to make the rights of indigenous peoples alive in practice, that they enjoy in the Political Constitution of Mexico City, specifically in the mayors of southern Mexico City, still with rural soil and culture, such as Xochimilco. Through the analysis documentary of analysis legislation, the review of works carried out on the subject and the compilation of empirical information of the legal and sociological accompaniment to the natives peoples, will be analyzed of various situations that indigenous peoples have faced in their territories and in the recognition of their rights already with the Constitution entered into force, as well as secondary laws and ordinances such as: the Citizen Participation Law (2019), the Law on the Rights of Resident Indigenous Peoples, Neighborhoods and Communities (2019), the Development Planning System Law (2019), and the amendments to Regulation 26 on social and popular housing (2021), we will outline some challenges of the recognition of the cultural diversity in the city and the long road that indigenous communities will still have to travel to advance their inclusion as subjects of law within their territories.
