Abstract

The article presents the results of a study on the issue of the collectability of cash benefits and interest adjudged for the benefit of the Justice Fund (Fund for Victims’ Aid and Post-Penitentiary Assistance), including an legal analysis, an analysis of statistical data on the functioning of the system of adjudication and enforcement of these measures, an analysis of the Fund’s budget data, as well as methodological foundations and the results of a court files study on judicial enforcement of the above-mentioned measures. The overall collection rate of the analysed monetary measures currently appears to be at a fairly good level. The effectiveness of its enforcement is statistically significantly improved by factors such as having a permanent job at the time of the criminal case or being a pensioner, the amount of income received, having no previous criminal record, ending the criminal case with a conditional discontinuance of proceedings and imposing a non-custodial sentence on the convicted person.
